The Uncontested Divorce Process in Orange County

Understanding the process helps you plan realistically. To file for divorce in Orange County, one spouse must have been a California resident for at least six months and an Orange County resident for at least three months immediately before filing. California is a no-fault divorce state, meaning the grounds for dissolution are irreconcilable differences, and no proof of wrongdoing is required.

Waiting Period & Financial Disclosures

California’s mandatory six-month waiting period under Family Code Section 2339 applies to all divorces, including uncontested cases. No court can shorten it, even when both parties are in full agreement. During that period, both spouses must exchange complete financial disclosures under Family Code Section 2104, covering income, assets, debts, and expenses.

What Your Agreement Must Cover Before Filing

An uncontested divorce requires both spouses to resolve every divorce-related issue in writing before the court can enter judgment without a trial. If any issue remains open, the case can transition to contested proceedings, which adds time and cost. Summary Dissolution: Eligibility & Limitations

A summary dissolution is a streamlined version of the uncontested divorce process, but its eligibility requirements are strict and cumulative. Most Orange County couples don’t qualify and proceed through the standard uncontested divorce process instead.

To qualify for summary dissolution, a couple must meet all of the following:

Married fewer than five years
No children of the relationship born before or during the marriage, or adopted during the marriage, and neither spouse is pregnant
No real estate owned or rented, other than a current residence under certain conditions
Community property valued under $57,000
Separate property valued under $57,000
Debts acquired since marriage not exceeding $7,000
Agreement that neither spouse will seek spousal support

Because all conditions must be met simultaneously, many couples who appear eligible on most criteria are disqualified by a single factor. Even couples who do qualify may benefit from legal counsel to verify eligibility, review asset characterization, and confirm the joint petition is correctly completed before filing.
