The Uncontested Divorce Process in Orange County

Understanding the process helps you plan realistically. To file for divorce in Orange County, one spouse must have been a California resident for at least six months and an Orange County resident for at least three months immediately before filing. California is a no-fault divorce state, meaning the grounds for dissolution are irreconcilable differences, and no proof of wrongdoing is required.

Waiting Period & Financial Disclosures

California’s mandatory six-month waiting period under Family Code Section 2339 applies to all divorces, including uncontested cases. No court can shorten it, even when both parties are in full agreement. During that period, both spouses must exchange complete financial disclosures under Family Code Section 2104, covering income, assets, debts, and expenses.

Filing & Court Review

Once the marital settlement agreement is finalized, it’s submitted to the Orange County Superior Court at the Lamoreaux Justice Center in Orange for review and entry of a judgment of dissolution.
