Military Divorce Matters We Handle

Military divorce cases can involve issues that don’t arise in civilian proceedings. We work with clients on the following:

Military retirement pay division: Military retirement earned during the marriage is generally treated as community property in California and may be divided as part of the marital estate.

Military Retirement Pay & the USFSPA

The Uniformed Services Former Spouses’ Protection Act (USFSPA), codified at 10 U.S.C. section 1408, authorizes state courts to treat a service member’s disposable retired pay as marital or community property in a divorce. It doesn’t require division; it permits a court to award a share of that retirement to the former spouse if state law supports it. Under California community property principles, retirement pay earned during the marriage is generally divided equally.

The 10/10 Rule & DFAS Payment Limits

The 10/10 rule is a detail that frequently causes confusion. It governs only whether the Defense Finance and Accounting Service (DFAS) will make direct payments to a former spouse, and it requires that the marriage overlapped at least 10 years of creditable military service. If that threshold isn’t met, DFAS won’t pay the former spouse directly, but a court can still award a share of the retirement, which the service member would then be responsible for paying personally.

Additional limits apply. DFAS generally won’t pay more than 50% of disposable retired pay for property division alone, and total withholding for property division combined with child support or alimony garnishment generally can’t exceed 65%.

The Survivor Benefit Plan

The Survivor Benefit Plan (SBP) is a separate but related consideration. SBP can provide continued income to a former spouse after the service member’s death. Preserving that coverage requires a timely election, and missing the deadline can eliminate the option entirely.

SCRA Protections, Residency Requirements, & Orange County Proceedings

The Servicemembers Civil Relief Act (SCRA), found at 50 U.S.C. section 3932, protects active-duty service members from having a divorce proceed without their participation when military duty prevents them from appearing. An active-duty service member can generally obtain a court-ordered stay of proceedings of at least 90 days when military obligations materially affect their ability to respond or appear, and additional stays may be granted beyond that initial period.

Default Judgments & SCRA Relief

The SCRA also addresses default judgments. If a default was entered against a service member while military duty prevented them from responding, the SCRA may allow that judgment to be set aside upon proper application.

California Residency Requirements for Service Members

California’s standard residency requirement to file for divorce is six months of state residency and three months of county residency. For service members, there’s a recognized exception: a service member stationed in California can generally satisfy this requirement even if their permanent home of record is in another state.
